ABC Texas Testimony on HB 1922
Testimony of Josue Reyes, President & CEO-D. Wilson Construction, before the Texas State Senate on Business & Commerce
Chairman Schwertner, Vice Chair King, and Members of the Committee:
My name is Josue Reyes. I’m the President and CEO of D. Wilson Construction in McAllen, and I’ve worked in Texas construction for over 27 years. I’m also a board member of the Associated Builders and Contractors of Texas.
I’m here today in strong support of HB 1922.
This bill addresses a serious flaw in how the Right to Repair statute currently functions—specifically, the confusion over when a cause of action officially accrues. Right now, that ambiguity is being used to bypass the law’s intent, dragging contractors like myself into long and costly lawsuits—without ever giving us the chance to fix the issue.
My company is currently facing five lawsuits that were filed after the Right to Repair law was passed. In each case, we weren’t given notice or a list of alleged defects before the lawsuit. We weren’t offered the opportunity to make repairs—just legal bills and reputational harm.
This is exactly what Chapter 2272 was supposed to prevent. HB 1922 helps restore that intent by making one simple but important clarification: that the accrual date begins when the contractor’s report is postmarked. That’s fair, clear, and predictable for both parties.
Right to Repair only works if we’re given the chance to actually repair. This bill reinforces that principle and brings much-needed certainty to the process.
